EB-1 Categories Overview

The EB-1 category is divided into three distinct subcategories, each with its own specific criteria. Understanding which path aligns with your qualifications is the first step toward a successful petition.

  • EB-1A: Extraordinary Ability: This category is for individuals who can demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. A key advantage of this subcategory is that it does not require a job offer or a labor certification.
  • EB-1B: Outstanding Professors and Researchers: This path is intended for professors and researchers who are internationally recognized for their academic achievements in a particular field. Applicants must have at least three years of experience in teaching or research and must have a job offer from a U.S. university or private employer.
  • EB-1C: Multinational Managers and Executives: This subcategory is for managers or executives who have been employed outside the U.S. for at least one of the preceding three years by a qualifying firm or corporation and who will be coming to the U.S. to continue service for that same employer, or a subsidiary or affiliate.

Proving Extraordinary Ability for an EB-1A Visa

To qualify for the EB-1A visa, an applicant must provide substantial evidence of their extraordinary ability. This is typically accomplished by showing a one-time major achievement (like a Nobel Prize) or by meeting at least three of the following ten criteria:

  • Receipt of lesser nationally or internationally recognized prizes or awards for excellence.
  • Membership in associations that demand outstanding achievement of their members.
  • Published material about you in professional or major trade publications or other major media.
  • Evidence that you have been asked to judge the work of others.
  • Proof of original scientific, scholarly, artistic, athletic, or business-related contributions of major significance.
  • Authorship of scholarly articles in professional or major trade publications or other major media.
  • Display of your work at artistic exhibitions or showcases.
  • Performance of a leading or critical role in distinguished organizations.
  • Commanding a high salary or other significantly high remuneration in relation to others in the field.
  • Commercial successes in the performing arts.

Requirements for Multinational Executives and Managers (EB-1C)

The EB-1C category requires a specific relationship between the foreign employer and the U.S. employer. The petitioning U.S. employer must have been doing business for at least one year and must be the same employer or a subsidiary or affiliate of the entity that employed the applicant abroad. The applicant must have been employed in a managerial or executive capacity and must be coming to the U.S. to serve in a similar role.

Priority Dates and Green Card Timeline

For many employment-based green card categories, applicants must wait for their “priority date” (the date the petition was filed) to become current before they can apply for permanent residency. The EB-1 category often has current priority dates, meaning applicants may be able to file their green card application concurrently with their visa petition, significantly shortening the overall timeline.

The general process involves filing Form I-140, Immigrant Petition for Alien Worker. Once approved and the priority date is current, the applicant can file Form I-485 to adjust their status to that of a lawful permanent resident.
