Individuals with Extraordinary Ability or Achievement (O-1 Visa)

What is an O-1 visa?

The O-1 visa is a nonimmigrant visa for individuals who have “extraordinary ability in the sciences, arts, education, business, or athletics.” Employers petition for foreign nationals who will be workers in the above fields with consistent records of national or international acclaim in their field.

How can Delgado Rompf Bruen LLC help with my case?

Delgado Rompf Bruen LLC will manage each step of your O-1 petitioning process. We will first ask you to submit documentation of your work and accomplishments in your field. We will then meet with you to discuss your case process and any issues that may arise, including assessing the category in which your field falls and applicable documentation to meet the “extraordinary ability” standard.

USCIS has released recent guidance on how foreign national students with STEM OPT may qualify for O-1 classification. Our attorneys are available to assist foreign national students with change of status petitions by advising on the best supporting documents to evidence the student’s extraordinary ability in their field.

The acceptable supporting documentation for O-1 classification depends on the field in which the individual is petitioning. Our attorneys have the expertise to assist employers, agents, and beneficiaries in identifying the strongest documentation to support their petition.

What information and documents do I need?

Documentary evidence for an O-1 visa typically requires evidence that the beneficiary has received an internationally recognized, major award, such as the Nobel Prize, Academy Award, Emmy, or Grammy, or evidence that shows the individual meets at least three other criteria demonstrating extraordinary ability in their field. This can include more field-specific awards, publication in nationally or internationally recognized journals, membership in associations for the field, and more. A list of acceptable supporting documentation can be found here.
