Litigation Updates: News on TPS for Venezuelans and Parole for Nationals of Cuba, Haiti, Nicaragua and Venezuela

The Secretary of Homeland Security recently announced the termination of two types of legal statuses: TPS for Venezuelans under the 2023 designation, and CHNV, parole for nationals of Cuba, Haiti, Nicaragua, and Venezuela. Both terminations were challenged in federal court.

On March 31, 2025, a U.S. District Court Judge halted the termination of TPS for Venezuelans as the lawsuit continues. This means that Venezuelans under the 2023 designations, whose statuses were set to terminate on April 7, 2025, remain in valid status through October 2, 2026. Accompanying employment authorization is valid through April 2, 2026.

On April 10, 2025, a U.S. District Court Judge ordered a stay of the termination of CHNV parole protection. As in the Venezuelan TPS case, individuals on CHNV parole will remain in their protected status as the case continues through the court.
