At Delgado Rompf Bruen LLC, we understand the heavy burdens you carry. We know that the United States immigration process can feel impossible, but you do not have to face it alone. Our dedicated team is here to guide you and help secure a safe future for you and your family. Eligibility for Asylum vs. Refugee Status Both asylum and refugee status offer protection to people who cannot return to their home countries because they have suffered past persecution or have a well-founded fear of future persecution. This fear must be based on race, religion, nationality, membership in a particular social group, or political opinion. The primary difference between the two categories is where you apply for protection: Refugee Status: You must apply for refugee protection while you are overseas, outside of the United States. Asylum Status: You can only apply for asylum if you are physically present inside the United States or seeking entry at a U. S. port of entry. Affirmative vs. Defensive Asylum Once you are in the United States, you will pursue asylum through one of two procedural pathways: Affirmative Asylum: This process applies if you are not currently in removal (deportation) proceedings. You proactively submit your asylum application to U. S. Citizenship and Immigration Services (USCIS) and attend a non-adversarial interview with an asylum officer. Defensive Asylum: You must use this pathway if you are in removal proceedings.... --- > Secure your future in the U.S. with our Chicago EB-1 visa attorneys. As a "first preference" employment-based category, the EB-1 visa is designed for priority workers who are leaders in their respective fields. Navigating this process requires dedicated guidance, and Delgado Rompf Bruen LLC is committed to providing the legal support you need. EB-1 Categories Overview The EB-1 category is divided into three distinct subcategories, each with its own specific criteria. Understanding which path aligns with your qualifications is the first step toward a successful petition. EB-1A: Extraordinary Ability: This category is for individuals who can demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. A key advantage of this subcategory is that it does not require a job offer or a labor certification. EB-1B: Outstanding Professors and Researchers: This path is intended for professors and researchers who are internationally recognized for their academic achievements in a particular field. Applicants must have at least three years of experience in teaching or research and must have a job offer from a U. S. university or private employer. EB-1C: Multinational Managers and Executives: This subcategory is for managers or executives who have been employed outside the U. For professionals whose work holds significant value for the United States, the National Interest Waiver (NIW) offers a unique and powerful pathway to permanent residency. Unlike traditional employment-based immigration routes, the NIW allows you to bypass the specific job offer and labor certification requirements, placing the control of your future directly in your hands. We understand that the complexities of U. S. immigration law can be daunting. Our attorneys provide the supportive and intelligent advocacy you need to prove your work matters to the nation. What is a National Interest Waiver? The NIW is a subcategory of the EB-2 visa (Second Preference Employment-Based Immigration). Typically, an EB-2 visa requires a specific job offer and a process called PERM Labor Certification, where an employer must prove there are no qualified U. S. workers for the role. The National Interest Waiver allows you to waive these requirements if you can demonstrate that your employment in the U. S. would benefit the nation. Qualifications for the NIW To qualify, you must first meet the basic eligibility requirements for the EB-2 category (holding an advanced degree or possessing exceptional ability). Additionally, you must satisfy a three-prong test established by the administrative decision Matter of Dhanasar. You must show that: Substantial Merit and National Importance: Your proposed endeavor has significant value, whether in business, science, technology, culture, health, or education, and its impact is broad enough to matter to... --- > The Chicago EB-2 Visa attorneys at Delgado Rompf Bruen LLC provide personalized guidance for advanced degree and exceptional ability immigration cases. Advanced Degree: This category is for professionals applying for a job that necessitates an advanced degree. To qualify, you must possess a U. S. master's degree (or higher) or a foreign equivalent. Citizenship and Immigration Services (USCIS) policies, changes in the political landscape, and the COVID-19 pandemic have all influenced the processing times for immigrant and nonimmigrant petitions. Adjudications of immigration cases are dependent on many circumstances. This includes the type of benefit sought, immigration and criminal history, and the office to which the application was submitted. You can check the average processing time for your application here. How can Delgado Rompf Bruen LLC help move my case forward? There are several options for addressing immigration delays. USCIS has hotlines, online tools, and emails for inquiries into case statuses. For many, the information centers provided by USCIS will not resolve their issue, but rather give a general timeline of when an adjudication can be expected. Delgado Rompf Bruen has experience in other avenues of requesting assistance with long-pending cases, including contacting the Ombudsperson and identifying the Congressional representatives who may be able to assist in addressing the delay. If all other methods are exhausted, Delgado Rompf Bruen can assist individuals with federal litigation to compel action by the government. What information and documents do I need? Many employers seeking to sponsor an employee for an employment-based permanent residency card must navigate the U. S. Department of Labor’s PERM (Program Electronic Review Management) process. PERM is a comprehensive, multi-step evaluation of the U. S. labor market designed to ensure that offering permanent employment to a foreign national will not adversely affect the job opportunities, wages, or working conditions of U. S. workers. Key stages in this process include obtaining a Prevailing Wage Determination from the U. S. Department of Labor and conducting thorough job recruitment efforts before submitting the final PERM application. However, PERM is just the first step in the journey toward employment-based permanent residency. After completing the PERM process, the employer must file Form I-140, Immigration Petition for Alien Worker. Once a visa becomes available in the applicable category, the employee can then proceed to adjust their status, either within the U. S. or through consular processing abroad. How Can Delgado Rompf Bruen LLC Help with My Case? The intricate, multi-step PERM process can be daunting, particularly for employers who are unfamiliar with it. The process begins with obtaining a Prevailing Wage Determination, which requires a nuanced understanding of job descriptions and the appropriate wage levels. Naturalization is the process of becoming a United States citizen. For many, naturalization is the end of a long road, typically beginning with nonimmigrant status, or no status, and then obtaining permanent residency, before ultimately naturalizing as a U. S. citizen. Becoming a U. S. citizen has many benefits, such as voting rights, traveling with a U. S. passport, and protection from deportation. Most individuals who choose to naturalize will do so either by proving that they have been lawful permanent residents for the last five years, or that they have been lawful permanent residents for the last three years, have lived with their U. S. citizen spouse for at least three years. Applicants for naturalization must show they meet the continuous residence and physical presence requirements, and that they have demonstrated good moral character in the years preceding their application. What is Acquired and Derived Citizenship? Certain individuals may acquire or derive citizenship by operation of law. This is common in situations where children are born to U. S. citizens outside the United States or when foreign nationals naturalize and have minor children who are U. S. permanent residents. Individuals who have derived or acquired citizenship may be eligible to file for a Certificate of Citizenship and/or a U. S. passport. Learn more about naturalization and citizenship here. Deferred Action for Childhood Arrivals (DACA) is a program that provides limited protection from removal and work authorization to eligible undocumented individuals who were brought to the United States as children. DACA does not provide lawful status, but it allows recipients to live and work in the U. S. with limited risk of removal for a renewable two-year period. To qualify, applicants must meet specific criteria, including continuous residence in the U. S. since June 15, 2007, physical presence on June 15, 2012, and educational or military service requirements. DACA recipients are granted deferred action, which means they are considered a low priority for removal. They can obtain a work permit (Employment Authorization Document) and, in some cases, apply for advance parole to travel abroad for humanitarian, educational, or employment purposes. However, DACA does not provide a direct pathway to lawful permanent residence or citizenship. Learn more about DACA here. How Can Delgado Rompf Bruen LLC Help with My Case? Learn how to check your registration status, key filing deadlines, and next steps for selected and non-selected applicants, plus alternative options to consider moving forward. - Published: 2026-04-01 - Modified: 2026-05-05 - URL: https://drbimmigration.com/uscis-completes-the-fy-2027-h-1b-lottery-what-employers-and-beneficiaries-should-do-next/ U. S. Citizenship and Immigration Services (USCIS) announced that it completed the H‑1B cap selection process for Fiscal Year 2027. Employers who submitted registrations can now view selection results in their USCIS online accounts, and those with selected registrations may begin preparing H‑1B petitions for filing. The agency has not yet released the total number of registrations submitted for FY 2027. However, as in prior years, demand exceeded the number of available H‑1B visas, and not every registration was selected. Understanding what this announcement means—and what steps should follow—is critical for both employers and foreign national workers. How to Check Selection Results USCIS is notifying employers and attorneys through the online H‑1B registration system. Each registration will show one of several statuses, including “Selected” or “Submitted. ” Selected registrations are eligible for petition filing Submitted registrations were not selected in the initial round but may still be considered if additional selections occur Only the sponsoring employer or its legal representative can access these results. Filing Window for Selected Registrations For registrations marked as Selected, USCIS has provided a filing window from April 1 through June 30, 2026. During this period, the employer must submit a complete H‑1B petition for the named beneficiary. Failing to file within this window will result in the loss of the selected H‑1B slot. Will There Be Additional Lottery Rounds? USCIS has indicated that if it does not receive enough approvable petitions during the filing period to meet the annual cap, it may conduct additional selection rounds later in the... --- > Learn how a federal government shutdown impacts immigration services, from USCIS and DOL to immigration courts, visas, and employer filings. - Published: 2025-09-25 - Modified: 2026-05-05 - URL: https://drbimmigration.com/how-a-federal-government-shutdown-could-impact-u-s-immigration/ During a federal government shutdown, many federal employees are furloughed, and only “essential” functions continue. Immigration services are affected in different ways depending on how each agency is funded. Below is an overview of what to expect, based on prior shutdowns and current information. U. S. Citizenship and Immigration Services (USCIS) Because USCIS is primarily funded by filing fees, most services are expected to continue uninterrupted. Applications, petitions, biometrics, and interviews are expected to proceed. However, some programs that rely on government appropriations may experience issues: E-Verify will be unavailable during a shutdown. In the past, USCIS permitted employers to continue using the new alternate I-9 document verification process when E-Verify is offline. The non-minister religious workers program will sunset on September 30, 2025, unless a Continuing Resolution or appropriations package is signed into law before that date. The shutdown should not impact religious worker permanent residency applications for ministers or R-1 and R-2 applications. Department of Labor (DOL) The Office of Foreign Labor Certification (OFLC) will close during a shutdown. This means: No processing of LCAs, PERM applications, or prevailing wage requests. No access to the FLAG system for filings. BALCA and DOL ALJ dockets will be put on hold. Because H-1B, H-1B1, and E-3 petitions require certified LCAs, employers with upcoming filings should submit them before September 30 to avoid delays. Similarly, employers in the PERM process should file as soon as possible to avoid missing deadlines. OFLC has sometimes issued guidance on flexibility after shutdowns, but none... --- > Update on the H-1B proclamation and new agency guidance. Learn more from a Chicago immigration attorney. Call us today! - Published: 2025-09-23 - Modified: 2026-05-05 - URL: https://drbimmigration.com/update-on-h-1b-proclamation-and-agency-guidance/ On September 19, 2025, President Trump issued a proclamation titled Restriction on Entry of Certain Nonimmigrant Workers. The proclamation adds a $100,000 fee for certain H-1B cases. It took effect at 12:01 a. m. EDT on Sunday, September 21, 2025, and is set to remain in place for one year. The following day, on September 20, 2025, USCIS and CBP released memoranda clarifying how the proclamation will be applied. The agencies explained that the new requirement applies only to H-1B petitions filed on or after September 21, 2025. In their words: “This Proclamation only applies to petitions that have not yet been filed. ” This means the proclamation does not apply to: Beneficiaries of petitions filed before the effective date, Beneficiaries of already approved petitions, or Individuals who already have a valid H-1B visa. In practice, this suggests that current and pending H-1B applicants are not subject to the new $100,000 fee. Renewals for H-1B holders also appear to be exempt. However, since the situation is still developing, we recommend that H-1B workers check with our office before traveling internationally. There are still many open questions, and legal challenges are expected. We will continue to provide updates as new information becomes available. --- > USCIS has reached the FY 2026 H-1B cap. On July 18, 2025, U. S. Citizenship and Immigration Services (USCIS) announced that it received enough petitions to reach these limits. USCIS accepted 65,000 petitions under the regular cap and 20,000 petitions under the advanced degree exemption (master’s cap). Because the agency met the statutory limits, USCIS will not accept or process any additional cap-subject H‑1B petitions for fiscal year 2026. Employers and individuals seeking H‑1B status through a cap-subject petition must now wait for the FY 2027 filing period. USCIS will continue to accept and adjudicate H‑1B petitions that qualify for cap-exempt status, such as those filed by certain nonprofit or research institutions or petitions for current H‑1B workers seeking extensions or changes in employment. If you have questions about H-1B eligibility, please schedule a consultation appointment here. --- > REAL ID is required starting May 7, 2025, for flights, federal facilities & military bases. A Skokie Immigration Lawyer can help you explore your options and plan ahead. - Published: 2025-07-08 - Modified: 2026-05-05 - URL: https://drbimmigration.com/tps-termination-for-haitians/ On June 27, 2025, the U. S. Department of Homeland Security (DHS) announced the termination of the Temporary Protected Status (TPS) for Haiti. The new end date for Haitian TPS was set for September 2, 2025, with employment authorization documents for Haitian nationals on TPS set to automatically extend to that end date. The decision was officially published in the Federal Registrar on July 1, 2025, and can be accessed here. However, on the same day, a federal judge in New York ruled that advancing the TPS end date by five months from its originally scheduled expiration is unlawful. This ruling temporarily blocks the September expiration date, pending further legal proceedings. The Trump Administration has clearly signaled that TPS for Haitians will end soon, whether in September or on its original end date of February 2026. In light of the uncertainty, we strongly encourage any affected individuals to begin preparing now. Employers should prepare for the potential reverification of work authorization and the possible departure of TPS employees. TPS holders from Haiti are strongly advised to consult with experienced immigration counsel to explore alternative immigration options and protect their future in the U. S. If you or someone you employ is a TPS holder from Haiti and would like to discuss possible immigration pathways, please contact Delgado Rompf Bruen LLC here. --- > Worried about ICE arrests at immigration courts? These arrests are part of a broader deportation effort that targets foreign nationals who may have entered the U. S. within the past two years. If you or someone you know is in removal proceedings or is scheduled to appear in immigration court, here’s what you need to know — and what to do if ICE targets you. Who Is Being Targeted? ICE has been focusing on: Individuals who entered the United States within the last two years People whose immigration court cases are being dismissed or terminated Those who have final orders of removal Individuals with prior encounters with ICE or CBP ICE officers wait in hallways or outside courtrooms to arrest individuals as they exit courtrooms. This unprecedented enforcement action raises serious concerns regarding violations of due process and the chilling effect this may have on individuals’ ability to pursue lawful relief in court. What Should You Do If DHS Tries to Dismiss or Terminate Your Case Before the Immigration Court? If you are in immigration court and the Department of Homeland Security (DHS) attorney requests that your case be dismissed or terminated — this could be a sign that ICE intends to you once you leave the courtroom- especially if you have been in the U. Both terminations were challenged in federal court. On March 31, 2025, a U. S. District Court Judge halted the termination of TPS for Venezuelans as the lawsuit continues. This means that Venezuelans under the 2023 designations, whose statuses were set to terminate on April 7, 2025, remain in valid status through October 2, 2026. Accompanying employment authorization is valid through April 2, 2026. On April 10, 2025, a U. S. District Court Judge ordered a stay of the termination of CHNV parole protection. As in the Venezuelan TPS case, individuals on CHNV parole will remain in their protected status as the case continues through the court. The termination becomes effective April 24, 2025. Parole is a status that grants authorization to enter the United States, but it is not considered an admission to the United States or a permanent immigration benefit. The termination of parole also terminates employment authorization obtained in connection with parole. Nationals of Cuba, Haiti, Nicaragua, and Venezuela who are present in the United States under parole with no other lawful status or pending application for lawful status will be directed to depart the United States before the final termination date of their parole. The final termination of parole is scheduled for April 24, 2025, unless the individual’s parole expires prior to this date. Remaining in the United States without a parole or lawful status may result in the DHS initiating removal proceedings against the individual. Here are the answers to a few common questions we receive about the H-1B lottery selection process. When will I know if I was selected? It typically takes a few days for the initial selection notifications to be completed. It is expected that all initial selections will be noted in the online system by Monday, March 31st. Notifications do not typically appear simultaneously for all registrants. How will I know if I was selected? USCIS posts selection notices in the employer’s myUSCIS account—the same account used to submit the registration. Beneficiaries do not have independent access to their registration status. Instead, sponsoring employers and their legal representatives are responsible for monitoring their accounts and informing beneficiaries of their selection status. If selected, the employer may download and share a copy of the selection notice with the beneficiary. If I am not selected by March 31, does that mean the process is over? Not necessarily. If a beneficiary is selected in the initial round, the registration status in myUSCIS will change to Selected. Registrations not selected will remain in Submitted status after March 31. In recent years, USCIS has conducted additional lottery selections later in the year if there are insufficient H-1B petition filings to meet the annual cap of 85,000. These additional selection rounds have typically occurred in late July and November. Employers do not need to take any further action to be considered for later rounds.... --- > Learn about electronic device searches at U.S. entry points, travelers' rights, and CBP policies. More than 20 states filed lawsuits to prevent the implementation of the order. On January 23, 2025, a federal judge temporarily blocked the order for 14 days while legal proceedings begin. On February 5, 2025, a federal judge issued a nationwide preliminary injunction that that blocks the order indefinitely. For now, birthright citizenship remains unchanged—all children born in the U.
