Practice Areas Professional Workers (H-1B)

What is an H-1B visa?

The H-1B visa is a professional work visa. Employers petition for foreign nationals who will be temporarily employed in professional fields, typically referred to as “specialty occupations.”

How can Delgado Rompf Bruen LLC help with my case?

Delgado Rompf Bruen LLC will manage each step of your H-1B petitioning process. We will first ask you to complete our H-1B questionnaire. We will then meet with you to discuss your case process and any issues that may arise, including assessing the position, wage, and qualifications of the employee.

We will next assist you in determining whether participation in the annual U.S. Citizenship and Immigration Services (USCIS) H-1B lottery is required. If it is, we will assist your company in registering for the lottery and monitor the process with you after submission. If selected, or if the lottery is not required, we will then help you prepare and monitor your H-1B submission. Our attorneys have the expertise to assist employers and beneficiaries in navigating timelines, documentation, and compliance with the law throughout the H-1B process. We routinely assist cap-exempt employers in filing applications and support our clients applying for extensions of stay for current H-1B employees and onboarding employees who require a transfer of their H-1B status from a prior employer.

What information and documents do I need?

Our H-1B questionnaire clearly outlines the information and documents required to file for an H-1B visa. This includes information about the employer, the specialty occupation position, and the employee.  Once your initial information and documentation are submitted, our attorneys and legal assistants will help you identify and obtain any additional required items.
