Intercompany Transferees (L-1)

What is an L-1 visa?

The L-1 visa is an intracompany transfer visa that allows employers to transfer qualified employees from a foreign office to one of their offices in the United States. There are two types of L-1 visas:

  • The L-1A visa is for executives and managers, allowing them to work in the U.S. for up to seven years.
  • The L-1B visa is for employees with specialized knowledge, permitting them to work in the U.S. for up to five years.

How can Delgado Rompf Bruen LLC help with my case?

While the requirements for an L-1 visa may seem straightforward, employers often face challenges in proving that the employee qualifies under one of the specific categories:

  1. Executive
  2. Manager
  3. Employee with specialized knowledge

Employers often struggle to provide the necessary documentation to support their claim that an employee fits into one of these categories. Our attorneys have extensive experience successfully documenting L-1A and L-1B petitions and can help ensure your petition is properly prepared.

What information and documents do I need?

For an L-1A visa, it’s essential to demonstrate that the beneficiary serves in an executive or managerial capacity. Key documentation includes:

  • Letters of support from other executives or managers outlining the beneficiary’s duties.
  • Organizational charts showing the employees the beneficiary supervises.
  • Experience letters detailing the length of time the beneficiary has served in this role and evidence of relevant prior experience.

For an L-1B visa, the focus is on proving the position requires specialized knowledge. Supporting documentation should include:

  • A clear description of the position’s responsibilities that require specialized knowledge.
  • Support letters describing the required specialized knowledge.
  • Evidence of the beneficiary’s academic background and work experience.

You can find our L-1 questionnaire, which outlines all the information needed for an L-1 petition, here.
