What is a T visa?

The T nonimmigrant visa is available to victims of human trafficking who assist law enforcement in the investigation or prosecution of the trafficking crime. To qualify for a T visa, you must demonstrate that you:

  1. Have been a victim of a severe form of trafficking in persons, which includes sex trafficking or forced labor;
  2. Are physically present in the United States, American Samoa, or the Commonwealth of the Northern Mariana Islands due to trafficking;
  3. Would suffer extreme hardship involving unusual and severe harm if removed from the United States; and
  4. Have complied with any reasonable requests for assistance from law enforcement in the investigation or prosecution of human trafficking (unless you are under 18 or unable to cooperate due to trauma).

The T visa provides the applicant with employment authorization and a path to lawful permanent residence in the United States.
