On June 27, 2025, the U.S. Department of Homeland Security (DHS) announced the termination of the Temporary Protected Status (TPS) for Haiti. The new end date for Haitian TPS was set for September 2, 2025, with employment authorization documents for Haitian nationals on TPS set to automatically extend to that end date. The decision was officially published in the Federal Registrar on July 1, 2025, and can be accessed here.
However, on the same day, a federal judge in New York ruled that advancing the TPS end date by five months from its originally scheduled expiration is unlawful. This ruling temporarily blocks the September expiration date, pending further legal proceedings.
The Trump Administration has clearly signaled that TPS for Haitians will end soon, whether in September or on its original end date of February 2026. In light of the uncertainty, we strongly encourage any affected individuals to begin preparing now.
Employers should prepare for the potential reverification of work authorization and the possible departure of TPS employees. TPS holders from Haiti are strongly advised to consult with experienced immigration counsel to explore alternative immigration options and protect their future in the U.S.
