Update on Birthright Citizenship

On January 20, 2025, President Trump signed an Executive Order regarding birthright citizenship for children born in the U.S. to mothers who are undocumented or on nonimmigrant visas. The order, set to take effect on February 19, 2025, has already faced legal challenges. You can read the Executive Order here.

More than 20 states filed lawsuits to prevent the implementation of the order. On January 23, 2025, a federal judge temporarily blocked the order for 14 days while legal proceedings begin. On February 5, 2025, a federal judge issued a nationwide preliminary injunction that that blocks the order indefinitely.

For now, birthright citizenship remains unchanged—all children born in the U.S. continue to be recognized as U.S. citizens. If the Executive Order does take effect in the future, it will not impact those who have already acquired citizenship by birth.
