What is the Board of Immigration Appeals?

The Board of Immigration Appeals (BIA) is the highest administrative body for interpreting and applying U.S. immigration laws.  The BIA is located within the Executive Office for Immigration Review (EOIR) at the Department of Justice, and handles appeals from immigration judge decisions and certain USCIS decisions.

If you are in deportation proceedings and the immigration judge denies your application for relief, you may be able to appeal that decision to the BIA, to determine whether the denial was erroneous.

  • The individual’s A#.
  • A copy of the complete filing submitted to the immigration judge
  • A copy of the final order issued by the Immigration Judge.
